Terms of Service

1. Acceptance

These terms cover using Mudl. Use the app, and you agree to them.

These Terms of Service (the "Terms") are an agreement between you and Beiler Ventures LLC ("we," "us," or "our"). Mudl is a registered assumed business name of Beiler Ventures LLC, a North Carolina limited liability company.

They apply when you create an account on, access, or use the Mudl mobile application, our website at trymudl.com, or any related service we operate (together, the "Service"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

Mudl is for adults of legal drinking age — 21 or older in the United States.

By using the Service you affirm that you are at least 21 years old and of legal drinking age where you live. The Service is intended for use in the United States and is not directed to anyone under 21.

We do not knowingly allow anyone under 21 to hold an account. If we learn that an account belongs to someone under that age, we will close it. If you believe a minor is using the Service, tell us at [email protected].

You also affirm that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under the laws that apply to you.

Drinking carries real risk, and using the Service means you accept it yourself. See Alcohol, risk, and responsibility.

3. Accounts and security

Your account is yours. Keep it that way.

When you create an account, give accurate information and keep it current. You are responsible for everything that happens under your account, including anything done by someone you let use it. Keep your password and any sign-in provider you connect — such as Google, Meta, or Apple — secure, and tell us promptly at [email protected] if you believe your account has been used without your permission.

Do not share, sell, or transfer your account. Do not create an account for anyone else without their permission, or on behalf of anyone who is not eligible under section 2.

You can delete your account at any time, in the app or by writing to us — see Delete your account for both paths and for what deletion removes. We may suspend or close an account that violates these Terms, that we are required to act on by law, or that poses a security risk. We may also stop offering the Service, or any part of it, with reasonable notice where notice is practical.

4. Acceptable use

Use Mudl for drinks. Not for the things on this list.

You agree not to use the Service to:

  • encourage, promote, or facilitate excessive, unsafe, or unlawful alcohol consumption, or present intoxication as an objective of using the Service;
  • provide, offer, sell, or otherwise make alcohol available to anyone under the legal drinking age, or to help anyone obtain alcohol who is not permitted to;
  • break any law that applies to you, including the alcohol laws of your state or locality;
  • impersonate another person, or misrepresent your affiliation with a bar, restaurant, brand, or any other business;
  • post content that is unlawful, infringing, defamatory, harassing, hateful, sexually explicit, or that depicts or targets minors in connection with alcohol;
  • upload malware, probe or breach our security, or interfere with the operation of the Service or anyone else's use of it;
  • scrape, bulk-download, resell, or systematically extract content or data from the Service, or access it through automated means outside the interfaces we publish;
  • reverse engineer, decompile, or disassemble the Service, except to the extent that restriction is unenforceable under the law that applies to you;
  • send unsolicited advertising, or use the Service to market unrelated goods or services.

We may remove content, and suspend or close accounts, that violate this section. We are not obligated to monitor content, but we may review it.

5. Your content and ratings

What you add stays yours.

The Service lets you add things: your own cocktail recipes, the bottles on your shelf, ratings and notes on drinks you have had, photos, and — if you operate a venue — menus and venue information. All of that is "your content." You keep whatever rights you already have in it. We do not claim ownership of it.

You give us a non-exclusive, worldwide, royalty-free license to host, store, copy, reformat, display, and distribute your content, but only so we can operate, secure, and improve the Service and show your content to the people you shared it with. Content you mark private stays private to your account. This license lasts as long as your content is on the Service; it ends when you delete the content or your account, except for copies retained in backups until they rotate out, and except where we are required to keep something by law.

You are responsible for your content, and you confirm that you have the rights to everything you upload. Do not upload a photo you did not take, or that you do not have permission to share, and do not upload text you copied from someone else. Ratings and reviews must reflect your genuine experience — do not post paid, traded, or fabricated ratings, and do not post ratings about a venue you have a financial interest in without saying so.

We may remove or restrict content that violates these Terms or the law. If you believe content on the Service infringes your copyright or trademark, write to us at [email protected] with enough detail to identify the work and the content in question, and we will review it.

6. Venue claims

Claim your room, and we check that it is yours.

Many venues are listed on Mudl before anyone from that business has ever spoken to us. If you run one of them, you can submit a claim — the bar's name and city, your name, your work email, and optionally the bar's website. When your email is on the venue's own domain, the claim can be verified on that basis. When it is not, we ask for a supporting document, such as a business card, license, or letterhead, and a person reviews it.

By submitting a claim you represent that:

  • you are authorized to act for that business;
  • the information you give us about yourself and the business is accurate; and
  • you will keep what you publish through the venue tools — menus, hours, descriptions, photos, and replies — accurate and lawful.

We decide whether to approve a claim. We may ask for more information, approve it, reject it, or reverse a decision later. We may revoke venue access at any time if we believe a claim was inaccurate, if the person is no longer authorized by the business, or if the venue tools are misused. A venue that has been claimed can also have its access managed by the owner of that venue's account on Mudl.

Claiming a listing does not give you ownership of the listing itself, of our compilation of venue data, or of anything else described in section 7. We may continue to show information about a venue from public sources whether or not it has been claimed.

7. Intellectual property

The Service — its software, design, text, imagery, and the way we organize and present cocktail and venue information — belongs to Beiler Ventures LLC or to our licensors, and is protected by copyright, trademark, and other laws. The MUDL name and mark, and our logos, are our trademarks. Do not use them without our written permission, except to refer to the Service accurately.

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service. That license does not include any right to resell it, to use it to build a competing product, or to extract our content or data as described in section 4.

Brand names, product names, and venue names that appear on the Service belong to their respective owners. We use them to identify the bottles, drinks, and places we describe. Their appearance on the Service does not imply any affiliation with, sponsorship by, or endorsement from those owners unless we say so plainly.

8. Third-party services

Some parts of the Service depend on other companies.

Those include, among others:

  • sign-in providers, where you choose to use one — such as Google, Meta, or Apple;
  • hosting, storage, and infrastructure providers that run the Service;
  • email delivery providers that send account and support messages;
  • map tiles from OpenFreeMap;
  • venue data from Foursquare's open dataset and from each venue's own publicly available website.

We do not control those services, and we are not responsible for them, for their availability, or for their content. Your use of a third-party service is governed by that company's own terms and privacy policy, not by these Terms. Links from the Service to another site or app are not an endorsement of it.

How we handle personal information, including what these providers receive, is described in our Privacy Policy.

9. Disclaimers

Mudl helps you find a drink. It does not pour one.

Mudl is a discovery and recipe tool. We do not sell, serve, or deliver alcohol, and we do not act as a retailer, distributor, or agent for any venue or brand. Any purchase you make happens between you and the business you buy from.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Venue information — hours, menus, prices, availability, and whether a place is still open — comes from public sources, from each venue's own website, and from venue operators. It can be incomplete, inaccurate, or out of date. Confirm anything that matters directly with the venue before you go.

Recipes, measurements, and ingredient information are provided for general use. They are not health, dietary, or allergen advice, and allergen information may be missing or wrong. If you have an allergy or a medical condition, check with the venue or the product's own labeling.

Alcohol carries its own risks, and those are set out in full in Alcohol, risk, and responsibility below.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply to you only to the extent permitted by law.

10. Alcohol, risk, and responsibility

Mudl shows you what to make and where to drink. What happens after that is yours.

You drink at your own risk, and you alone are responsible for everything that follows. Alcohol impairs judgment, coordination, and reaction time. Drinking can cause injury, illness, dependency, and death, and its effects differ from person to person and from one night to the next. By using the Service, you accept those risks yourself.

What we are not responsible for

To the fullest extent permitted by law, Beiler Ventures LLC and its members, managers, employees, and contractors are not liable for any injury, illness, death, property damage, loss, arrest, citation, fine, conviction, or other harm arising out of or relating to:

  • your consumption of alcohol, or anyone else's;
  • anything you do, or fail to do, after drinking — including operating a vehicle, boat, or machinery;
  • a recipe, measurement, ingredient, or strength figure shown in the Service, or any drink made from one;
  • alcohol you serve, buy, or provide to another person; and
  • a venue you found through the Service, or anything that happens there.

Never drink and drive

If you have been drinking, do not drive. Arrange another way home before you start. Driving after drinking is your decision alone, and every consequence of it — to you or to anyone else — is your responsibility, not ours. Nothing in the Service tells you that you are safe to drive.

Strength figures are not a safety measurement

Recipes, measurements, and any strength or ABV figure in the Service are approximations for general use. Real strength varies with the product you pour, how much you pour, dilution, and serving size. Never use anything in the Service to judge whether you are fit to drive or safe to keep drinking. That judgment is yours, and the safe answer is not to drive.

Serving other people

If you make or pour drinks for anyone else, you are responsible for whom you serve and how much — including not serving anyone under 21 or anyone who is visibly intoxicated — and for following the dram-shop, social-host, and licensing laws where you are. We are not a party to any of that.

Never for anyone underage

The Service is for adults of legal drinking age (see Eligibility). Nothing in it is intended to encourage, assist, or glamorize drinking by anyone under 21. Using it to obtain, make, or supply alcohol for a minor breaches these Terms and, in most places, breaks the law.

Not medical or health advice

Nothing in the Service is medical, health, or dietary advice. Alcohol interacts with many medications and medical conditions, and no amount is considered safe during pregnancy. If you are pregnant, taking medication, or managing a health condition, talk to a doctor.

We do not encourage excessive drinking. If your drinking worries you, or someone close to you, speak to a healthcare provider or contact the SAMHSA National Helpline at 1-800-662-HELP (4357) — free, confidential, and available 24 hours a day in English and Spanish.

This section survives any termination of these Terms and applies alongside the limits in Limitation of liability.

11. Limitation of liability

To the fullest extent permitted by law, Beiler Ventures LLC and its members, managers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or relating to your use of the Service — even if we have been advised that such damages are possible.

To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed one hundred United States dollars (US$100).

Some jurisdictions do not allow the limitation or exclusion of certain damages. Where that is the case, the limits above apply to you only to the extent permitted by law. Nothing in these Terms limits liability for fraud, or for anything else that cannot be limited by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Beiler Ventures LLC and its members, managers, employees, and contractors from any claim, demand, loss, or expense — including reasonable attorneys' fees — brought by a third party and arising out of your content, your use of the Service, your breach of these Terms, or your violation of any law or of anyone else's rights.

We may take over the exclusive defense and control of any matter subject to this section, at our own expense, and you agree to cooperate with that defense. You will not settle any such matter in a way that imposes an obligation on us without our written consent.

13. Governing law

These Terms, and any dispute arising out of them or out of your use of the Service, are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws rules.

You and we agree that any such dispute will be brought exclusively in the state or federal courts located in the State of North Carolina, United States, and each of us consents to the personal jurisdiction of those courts and waives any objection that they are an inconvenient forum.

If any part of these Terms is held unenforceable, that part will be limited or removed to the minimum extent necessary and the rest will stay in effect. Our not enforcing a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.

14. Changes and contact

When these terms change, we say so.

We may update these Terms as the Service changes or as the law requires. When we do, we will change the "Last updated" date at the top of this page. If a change is material, we will give notice before it takes effect — in the app, or by email to the address on your account. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service and delete your account.
